What is a mobile business?
Mobile businesses are operated from a vehicle or are conducted at various locations rather than from a fixed commercial premises. They must not adversely affect the amenity of the surrounding locality where they operate.
Common examples of mobile businesses include, but are not limited to, food trucks, mobile dog grooming services and trades.
Approvals
Mobile-based home businesses do not require development approval or a building permit, provided the following is met:
- no clients or customers travel to or from the business owner’s residential dwelling
- the business owner’s residential dwelling is only used for administrative purposes, such as bookkeeping and phone calls
- no structures or changes to the external façade of the dwelling are required.
A mobile-based home business will still require Health Approvals.
All food vehicles and food trailers operating within the Shire of Harvey are required to obtain food business registration and a Traders and Stallholders or Mobile Trader (Trading) Permit prior to commencing operations.
Food registration
All food vehicles and stalls trailers are required to comply with the Food Act 2008 and the Australia New Zealand Food Safety Standards.

Trading Permit
All mobile food vehicles and stalls are required to hold a Mobile Trader (Trading) Permit issued by the Shire of Harvey.
Mobile food traders are encouraged to operate within the pre-approved locations identified in Policy 4.3.2 – Trading in Public Places for Food Vendors, however alternative locations may be considered by the Shire.
A valid permit must be displayed and/or produced upon request.
Once approval has been granted, the applicable permit fee must be paid prior to the commencement of trade.

Approval from Environmental Health Services is not required for mobile pet grooming businesses. Operators must, however, ensure the following conditions are met:
- All wastewater generated during business operations must be discharged to sewer and must not be released to the environment, including stormwater systems, soakage pits, gardens or drains;
- Animal waste must be securely contained and disposed of in a manner that does not create a health nuisance; and
- Noise generated as part of business operations must comply with the Environmental Protection (Noise) Regulations 1997.

Approval from Environmental Health Services is not required for mobile mechanical servicing businesses.
Operators are responsible for ensuring their activities do not cause pollution to land, air or water.
When undertaking mechanical servicing, operators should take appropriate measures to minimise environmental impacts, including:
- Carrying out servicing on a flat, impermeable surface where practicable, and in a covered or weatherproof area if rain is likely;
- Using suitably sized drip trays or spill mats beneath vehicles to capture fluids;
- Maintaining a portable spill kit within the service vehicle to enable spills to be promptly contained and cleaned; and
- Ensuring all solid and liquid wastes are disposed of at an approved recycling or disposal facility.

Health Services approval is not required for mobile cleaning businesses. Operators must ensure that cleaning activities do not result in environmental pollution, including impacts to land, air or water.
Cleaning businesses should implement appropriate controls to manage environmental risks, including:
- Preventing wash water, detergents or chemicals from entering stormwater drains or natural water bodies;
- Using containment methods where practicable to manage runoff;
- Carrying spill containment equipment to manage accidental releases; and
- Disposing of wastewater and waste materials at an approved disposal or recycling facility.
