Under the PRIS Act, personal information is:
“Information or an opinion, whether true or not, and whether recorded in a material form or not, that relates to an individual, whether living or dead, whose identity is apparent or can reasonably be ascertained from the information or opinion;”
This includes, but is not limited to:
- Name, date of birth and address
- Contact details
- Location information
- Unique identifiers (e.g. driver’s licence number or IP address)
- Information relating to an individual’s physical, genetic, cultural or behavioural characteristics
Personal information may also include opinions and inferences made about an individual.
You can apply to amend personal information in documents held by the Shire of Harvey where that information is inaccurate, incomplete, out of date or misleading.
There are no charges for making an application to amend personal information and a notice of decision will be provided within 30 calendar days.
How to make an application
Under the FOI Act (section 46) an application for amendment to personal information has to:
- Be in writing.
- Give enough details to identify the document.
- Give details of the matters in relation to which the person believes the information is inaccurate, incomplete, out of date or misleading.
- Give the person’s reasons for holding those beliefs.
- Give details of the requested amendment.
- Give an Australian address for correspondence.
- State whether the person wishes the amendment to be made by altering, striking out or deleting, inserting or inserting a note in relation to information; and
- Be lodged at the Shire of Harvey via post, in person or via email.
How information is amended
Information can be amended by:
- Altering information
- Striking out or deleting information
- Inserting information
Information cannot be amended in a way that obliterates the information, or destroys the document, without the approval of the Information Commissioner.
You have existing rights to access any personal information held by the Shire under the Freedom of Information Act 1992 (WA) (FOI Act).

The PRIS Act provides you with additional rights to access your personal information held by our contracted service providers.
The PRIS Act also includes a “no wrong door” policy. This means that, regardless of whether you apply to access your personal information under the FOI Act or the PRIS Act, your application will be treated as having been made under the correct legislation.
